The Inter-authority Recoupment (England) (Amendment) Regulations 2026 – The new regulations, which concern inter-authority recoupment, were laid and came into force on Tuesday 1 September 2026. They update the arrangements for recouping costs between local authorities for looked after children with SEND who are placed out of area. The amendments also introduce a new requirement for the local authority that looks after the child to meet the costs incurred by the authority providing the education, where the child has an EHCP or attends a special school and agreement on costs is not reached within six months. The Department has published guidance alongside the regulations to support their implementation - Local authorities’ recoupment of the education costs of looked after children - GOV.UK.
