Policy Statement

The London Borough of Waltham Forest will monitor the operation and impact of the Fair Access Protocol to ensure that it remains effective, equitable, timely and focused upon securing positive educational outcomes for children and young people.

Monitoring will consider not only whether children are admitted to schools, but whether the Protocol supports successful and sustainable educational placements.

Strategic oversight will be undertaken in partnership with schools and relevant admission authorities and will inform the continuing development of Fair Access and wider inclusion arrangements.

21.1 Purpose of Monitoring

Monitoring should enable the Council and its partners to understand:

• whether eligible children are accessing education promptly;
• whether Fair Access responsibility is distributed equitably;
• whether placements are successful and sustainable;
• whether particular groups of children experience different outcomes;
• whether operational barriers or delays are emerging;
• whether the Protocol is being applied consistently;
• whether support arrangements are effective; and
• whether changes to policy or practice are required. 

21.2 Performance Information

The Council may monitor information including:

• number of referrals received;
• number accepted for Fair Access consideration;
• reasons for referral;
• age and year group;
• Primary and Secondary phase;
• time from referral to Panel consideration;
• time from recommendation to admission;
• distribution of placements between schools;
• placement outcomes;
• attendance following admission where appropriate;
• placement stability;
• repeat Fair Access involvement;
• reintegration outcomes;
• differences of opinion and escalations;
• reconsideration requests;
• relevant equality information; and
• other information necessary to evaluate the effectiveness of the Protocol. 

Monitoring should be proportionate and undertaken in accordance with data-protection requirements.

21.3 Fair Distribution

Strategic monitoring should assess whether Fair Access placements are being distributed equitably across participating schools.

This assessment should not rely solely upon simple numbers of placements.

Where appropriate, consideration should include:

• school size;
• year-group size;
• timing and frequency of placements;
• previous Fair Access admissions;
• relevant characteristics or needs of pupils admitted;
• school circumstances;
• placement outcomes; and
• other contextual information relevant to understanding distribution. 

The purpose is to support collective responsibility rather than create a mechanical allocation formula.

21.4 Timeliness

The Council will monitor the time taken to progress children through the Fair Access process.

Where recurring delays are identified, consideration should be given to their cause and to any action necessary to improve the process.

Particular attention should be given to children and young people whose circumstances make interruption to education especially significant, including Year 11 students and other vulnerable learners.

21.5 Placement Outcomes

Success should not be measured solely by whether a child or young person has been admitted to a school.

Where appropriate, strategic monitoring should consider:

• whether admission occurred promptly;
• whether the placement was sustained;
• attendance and engagement;
• educational continuity;
• whether additional intervention was required;
• whether the placement subsequently broke down;
• successful reintegration from Alternative Provision; and
• wider educational outcomes where relevant and proportionate. 

This reflects the Protocol's central principle that the objective is a successful and sustainable educational placement, rather than admission alone.

21.6 Equality and Inclusion

The Council should use available information to consider whether the Fair Access Protocol is operating equitably for different groups of children and young people.

Where patterns or disparities are identified, these should be explored to determine whether further analysis, policy review or operational action is required.

Monitoring should support the Council's wider commitment to inclusion and equitable access to education.

21.7 Strategic Learning and Continuous Improvement

Information arising from Fair Access should be used to support continuous improvement.

This may include identifying:

• recurring barriers to admission;
• emerging patterns of educational vulnerability;
• pressures within particular year groups or phases;
• areas where earlier intervention may be beneficial;
• recurring disagreements or governance issues;
• transition or reintegration challenges;
• training or guidance needs; and
• opportunities for improved partnership working. 

Fair Access monitoring should therefore contribute to the wider understanding of inclusion across Waltham Forest rather than operate solely as an admissions performance measure.

21.8 Review of the Protocol

The Council will keep the Fair Access Protocol under review in partnership with schools and admission authorities.

Formal review should take account of:

• changes to legislation or statutory guidance;
• changes to the School Admissions Code;
• local operational experience;
• performance and outcome information;
• feedback from participating schools and partners;
• equality considerations;
• governance issues; and
• learning arising from individual or recurring cases. 

Material amendments should be considered through the appropriate consultation and governance arrangements.

Associated operational documents, including the Fair Access Panel Terms of Reference, should also be reviewed following approval of the Protocol to ensure continued alignment.

21.9 Strategic Accountability

Strategic oversight of Fair Access remains a Council responsibility undertaken in partnership with schools and admission authorities.

The Council should ensure that appropriate information is available to support oversight of:

Access → Fair Distribution → Timeliness → Placement → Support → Stability → Educational Outcomes

This provides the basis for evaluating whether the Protocol is achieving its intended purpose.

• Fair distribution should be assessed contextually rather than through a simple numerical formula.
